Terms of Use

1. About these terms

These terms apply to your use of the website ghgreporting.ai and the platform at app.ghgreporting.ai, both operated by GHGReporting Sdn. Bhd. (Registration No. 20261010355). By using either, you agree to these terms.

If your organisation has signed a Client Services Agreement, Operator Partner Agreement or other agreement with us, that agreement governs the paid service. Where it differs from these terms, the signed agreement prevails.

2. Accounts

• Platform accounts are created for organisations. Your organisation's administrator decides who has access and what each person can do.
• You must keep your sign in details private, use two step sign in where we require it, and tell us at support@ghgreporting.ai straight away if you think someone else has used your account.
• You are responsible for activity under your account.

3. Acceptable use

You must not:

• enter information you know to be false or misleading;
• try to reach data, accounts or parts of the platform you are not authorised to use;
• test, probe or disrupt the security or operation of the website or platform without our written permission;
• upload harmful code or use automated tools to copy or overload the service;
• use the service in breach of any law, or to infringe anyone else's rights;
• resell or share access with people outside your organisation without our written agreement.

We may suspend access that puts the service or other users at risk, and will tell your organisation's administrator why.

4. Your data

Your organisation owns the data it records in the platform. You give us permission to store, process and display that data to provide the service, to support you, and to produce totals that do not identify your organisation. We will not name your organisation publicly or to investors without your written permission.

You are responsible for the accuracy and lawfulness of the data your organisation records, and for having the right to record any personal data it contains.

5. Reports and certificates

• Reports are prepared using the methods and emission factors shown in each report, and are mapped to the reporting frameworks named in them, such as the GHG Protocol, GRI 306 and IFRS S2.
• Reports and certificates reflect the records entered in the platform. A certificate records that a report was produced through the platform; its status can be checked at ghgreporting.ai/verify.
• We do not review, approve or sign off your reports, and our reports have not been reviewed by an external party unless the report says so. Your organisation remains responsible for its own disclosures and for any external review its regulators or stakeholders require.
• Nothing on the website or platform is legal, accounting, tax or investment advice.

6. Our intellectual property

The website, platform, software, report designs, methods documentation and our brand belong to us or our licensors. You may use them only to receive the service. Reports produced for your organisation may be used, shared and published by your organisation for its own reporting.

7. Availability and changes

We aim to keep the service available at all times, but it may be interrupted for maintenance, upgrades or events outside our control. We publish service status at status.ghgreporting.ai. Service levels for paying clients are set out in their signed agreement. We may improve or change features; we will not remove a feature your organisation relies on during a paid term without notice.

8. Third party services

The service connects to third party services such as payment, email and accounting providers. Their own terms apply to your direct use of them, and we are not responsible for services we do not control.

9. Liability

• To the extent the law allows, we are not liable for indirect or consequential loss, loss of profit, or loss caused by inaccurate data entered by users.
• Our total liability arising from use of the website or platform is limited to the fees your organisation paid us in the 12 months before the claim, or RM1,000 if no fees were paid.
• Nothing in these terms limits liability that cannot be limited by law.

10. Ending use

You may stop using the website at any time. Ending a paid subscription is covered by our Refund and Cancellation Policy and your signed agreement. We may close accounts that breach these terms after giving notice, except where immediate action is needed to protect the service.

11. Changes to these terms

We may update these terms. The effective date at the top shows the latest version; platform users will be told of important changes by email before they take effect.

12. Governing law

These terms are governed by the laws of Malaysia, and the courts of Kuala Lumpur have jurisdiction over any dispute.
